1.
All production agreements must be accompanied by an official purchase order (from the client) to form part of the contract along with any planning documents, storyboards, treatment and quote (produced by us).
[We will have a signed, legal agreement in writing]
2.
All work outside of the contract set out as described above is chargeable at our standard day rates. There are no exceptions to this unless it is work we have explicitly agreed to do at no cost (maybe because we like you, it will just look cooler, we're wanting to try out a new technique, etc.).
[We need to make some profit to survive, like any business]
3.
Any gross mistakes on the part of the client which cause large portions of the project to need reworking are chargeable at our standard day rates.
[Some people cause big problems which are outside of our responsibility, and it's fair that they pay for this stuff as we don't charge you for our mistakes]
4.
Costings will be itemised as far as possible on quotes, and projects part invoiced at each subsequent month-end until complete. If payment is delayed on part invoices, work may have to stop on the relevant project until the client fulfils their part of the arrangement. Payment terms are strictly 30 days from date of invoice.
[We need cash flow, if a situation arises where cash flow from a particular job stops, we're gonna have to work on something else to pay the rent - apologies to those thinking we run a 12 month interest free credit scheme]
5.
Ownership and copyright of all project assets will remain our property until paid for in full. This includes any interest accrued on overdue invoices.
[You can't legally publish or present our work anywhere until you own it. You don't own it until it has been paid for]
6.
Upon successful, complete, payment for the project, ownership and copyright of the deliverables is assigned to the client. All source footage and project software files remain the property of Boy.
[You own your finished production, but we do not release project production files used to make it to you - they hold much information about our techniques and technologies which we worked hard to develop, and we are protective of that stuff, like any business with the intellectual property which makes it unique]
Careful, professional planning is important in what we do.
Historically we've done a lot of rush jobs ('look how dynamic and up for it we are, yay!'), where the client has left things very late to issue us with an instruction to commence a project. We thought this constituted good service, but overall it lead to disappointment as the quality of the work suffered due to running out of time. It makes us too sad to do poor work. Please let us work together and make only good things.
We will undertake as much of the planning as we can, we generally need an initial meeting to discuss the project, and for the client to complete a creative brief form, from there on in the project is managed by us, with as much involvement as the client wishes.
